Knowing how the probationary period or a mobility clause works, whether one can refuse a change in working hours, or under what conditions a company can dismiss employees in the event of economic difficulties: these are all questions that every employee and employer should be able to answer. Even more so, since the risks are even greater (strikes, criminal court), knowing what attitude to adopt in collective labor relations. Deliberately accessible to non-specialists, this book aims to inform the reader, but above all to provide an insider's understanding of this fascinating subject that is today's labor law. Rewritten on the basis of the new Labor Code, this 18th edition includes the most recent legal developments (working hours, mobility in the event of an economic redundancy project, senior plans, union section representative, representativeness, etc.), as well as jurisprudential ones: non-compete clauses, geographical mobility, now confronted with the demands of private life, equal treatment, stress and workload, obligation to adapt and reclassify in the event of economic redundancy, taking note of the termination, not to mention the important judgments of July 8, 2009 on collective bargaining in companies. In a lively style, with numerous concrete examples sometimes showing the difference between the law in the Code and the law in life, the author invites the reader to follow the journey of an employee, from hiring to the termination of the employment contract. This first part on individual labor relations is followed by the second, relating to collective relations (unions, staff representatives, works councils). The very eventful third part deals with conflicts and, above all, the new collective bargaining law, which is undergoing a complete revolution one year after the law on social democracy of August 20, 2008, which has already led to a brutal restructuring of actors in many companies, but to more legitimate collective agreements. Self-assessment questionnaires and mini practical cases allow the reader to regularly check their understanding.
