The overhaul of Community directives on public procurement in 2004, the creation of partnership contracts in 2004, the reform of development concessions in 2005, a new reform of the public procurement code in 2006... This demonstrates considerable normative activity in the field of public contracts. This normative activity is accompanied by new phenomena: the emergence of public contracts in political debate and the development of supra-legislative principles applicable to "public procurement." A method of administration, the administrative contract is also, and increasingly, an economic issue. These strong developments unfold against a backdrop constantly woven by texts and jurisprudence, but whose framework is ancient. The general rules, of jurisprudential origin, have a character of permanence, which does not prevent them from perpetually adapting to administrative and economic reality through small touches or, sometimes, reversals. This book strives to present both a current vision of the general theory of contracts and an exposition of the regime of the main special public contracts. It examines, in particular, public procurement contracts, delegated public service management agreements, and public domain occupation agreements. Compared to previous editions, the study of special contracts has been enriched by the addition of a chapter on partnership contracts and a chapter on development concessions. A teaching tool, this manual aims to provide up-to-date information on recent reforms. It also reflects experience and seeks to provide answers to legal users who, in this field, are also partially its authors.
